Legal entitlements

People diagnosed with mesothelioma may be eligible for compensation. In Western Australia, there are two main types of entitlements. The first is a statutory claim through WorkCover WA, which can provide a lump sum payment and/or reimbursement of medical expenses. The second is a court claim for damages in the Supreme Court of Western Australia. Generally, court claims offer a higher level of compensation compared to workers’ compensation claims.

While compensation cannot reverse the effects of illness, it can assist with covering expenses and provide financial stability. 

Seeking compensation

A court claim for damages may include compensation for general damages (such as pain and suffering), past and future medical costs, care requirements, adaptive equipment, reduced life expectancy, and legal costs. Individuals who have had to stop working due to illness may also be able to claim for economic loss. 

Compensation may also be available for individuals diagnosed with asbestosis, diffuse pleural fibrosis, pleural thickening or disease, and asbestos-related lung cancer. Due to strict time limits on lodging claims, it is recommended that individuals seek legal advice as soon as possible. Claims must generally be filed during the lifetime of the person affected.
